Terms of Service

1. Acceptance of terms

By accessing or using LaunchSafe (the "Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that company.

2. The service

LaunchSafe provides autonomous adversarial testing — an AI agent that reads source code, probes live applications, and produces reproducible findings. You define the scope; we never attack systems outside that scope.

3. Customer responsibilities

You must own, or have written authorization to test, every target you submit. You agree to provide accurate scope, valid credentials where applicable, and rules of engagement. You are responsible for actions taken by users of your account.

4. Acceptable use

You may not use the Service to attack systems you do not own, exfiltrate third-party data, evade rate limits, or reverse-engineer the Service. We reserve the right to suspend accounts that violate these conditions.

5. Findings and disclosure

Findings produced by the Service are provided to you for remediation. You may share them with auditors, vendors, and counsel. Public disclosure of vulnerabilities in third-party systems must follow coordinated disclosure norms.

6. Fees and billing

Paid plans are billed in advance, monthly or annually. Usage above plan limits is billed at the rates published on our pricing page. Refunds are pro-rated for unused time on annual plans cancelled within 30 days.

7. Intellectual property

We retain all rights to the Service, the agent, and our methodology. You retain all rights to your code, your data, and the findings produced for you. We may use anonymized, aggregated metrics to improve the Service.

8. Confidentiality

Each party agrees to protect the other's confidential information with at least the same care it uses for its own, and not less than reasonable care. Findings, source code, and architecture details are confidential by default.

9. Warranties and disclaimers

The Service is provided "as is." Security testing is inherently probabilistic — no tool can guarantee discovery of every vulnerability. We disclaim all implied warranties to the fullest extent permitted by law.

10. Limitation of liability

To the extent permitted by law, our aggregate liability under these Terms is limited to the fees paid by you to LaunchSafe in the twelve months preceding the claim.

11. Termination

Either party may terminate these Terms with 30 days' written notice. We may suspend access immediately if you breach Acceptable Use. Upon termination, your data will be available for export for 30 days.

12. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Disputes shall be resolved in the state or federal courts located in Delaware.
